A frequent fear of some Medi-Cal beneficairies is that the state will "take" their home after they die, if they are a Medi-Cal recepient. It's not quite that simple, and there are some significant exemptions. There is an excellent article from California Advocates For Nursing Home Reform (CANHR) that discusses this issue, from their February 2016 newsletter. If you have questions about Medi-Cal recovery, this is an excellent starting place. Just go to CANHR.org and search for Medi-Cal recovery FAQ. The article is entitled Medi-Cal Recovery Frequently Asked Questions (FAQ).
Attorney Sandra Clark of this firm does practice regularly in this area, frequently doing Medi-Cal asset protection planning, including spousal property petitions and Medi-Cal Asset Protection Trusts. If you have a loved one facing the expense of long term nursing care, we may be able to help, and protect assets for the benefit of the non-institutionalized spouse.
